TERMS AND CONDITIONS

By purchasing, installing, or using any products sold by EMOTO VOLTZ (“we”, “us”, “our”), you agree to be bound by these Terms and Conditions. If you do not agree, you must not purchase or use our products.





2. Products & Intended Use



All products sold by EMOTO VOLTZ are aftermarket motorcycle, e-bike, and bicycle parts intended for off-road, private property, or competition use only, unless explicitly stated otherwise.


It is solely the customer’s responsibility to:


  • Confirm product compatibility before purchase
  • Ensure the product is legal for use in their jurisdiction
  • Ensure correct installation and safe operation



We make no representation or guarantee that any product complies with road laws, safety standards, or manufacturer warranties.





3. Installation & Use Risk



All products are installed and used entirely at the customer’s own risk.


EMOTO VOLTZ is not responsible for:


  • Incorrect or improper installation
  • Misuse or abuse of products
  • Modifications made before or after installation
  • Use beyond intended or manufacturer specifications



Professional installation by a qualified technician is strongly recommended. Failure to do so removes any responsibility from EMOTO VOLTZ.





4. Limitation of Liability



To the maximum extent permitted by law, EMOTO VOLTZ shall not be liable for any:


  • Personal injury or death
  • Property damage
  • Mechanical or electrical failure
  • Loss of income, profit, or business
  • Indirect, incidental, or consequential loss



arising from the purchase, installation, use, misuse, or inability to use any product sold by EMOTO VOLTZ.


Under no circumstances shall our total liability exceed the original purchase price of the product.


EMOTO VOLTZ is not liable for any failure of a complete vehicle or system arising from the installation or interaction of any component sold.




5. Australian Consumer Law



Nothing in these Terms excludes, restricts, or modifies any rights available to consumers under the Australian Consumer Law (ACL).


Where permitted by law, EMOTO VOLTZ’s liability is limited, at our discretion, to:


  • Replacement of the product
  • Repair of the product
  • Refund of the purchase price






6. No Warranty on Performance or Safety



Unless expressly stated in writing, all products are supplied “as is.”


EMOTO VOLTZ makes no warranty or representation regarding:


  • Performance improvements
  • Suitability for any specific purpose
  • Durability under extreme or competitive use
  • Safety outcomes






7. Assumption of Risk



You acknowledge that riding bicycles, e-bikes, and motorcycles involves inherent risks, including serious injury or death. By purchasing from EMOTO VOLTZ, you voluntarily assume all risks associated with the use of our products.





8. Indemnity



You agree to indemnify and hold harmless EMOTO VOLTZ, its owners, employees, and affiliates from any claims, losses, damages, liabilities, or legal costs arising from your use or misuse of any product.





9. Returns & Refunds



Change-of-mind returns are accepted only if the item is:


  • Unused
  • Uninstalled
  • In original packaging



Electrical components, installed items, and clearance products are non-returnable, except where required under Australian law.





10. Governing Law



These Terms and Conditions are governed by the laws of Australia, and any disputes shall be resolved exclusively in Australian courts.





11. Amendments



EMOTO VOLTZ reserves the right to amend these Terms and Conditions at any time without notice. Continued use of our website or products constitutes acceptance of the updated Terms.
